1849 california gold rushI have a question, with the current retrogression and processing dates what is the time for one to get a green card, given that the labor,I-140 being cleared within months, but what is the overall time to wait. Is the process moving forward or is there any improvement ?.

Welcome to world of GC.As of now,you will able to get your GC may be in 8-12yrs(minimum years) and the max cannot be calculated.If you have on your first H1 then it is right now to file for GC as you may get 3-year extension based on I140 approcal after you finish all the six years on H1..or some kind of bill may get passed before you complete all the six years and you will get the plastic(GC)..

California Gold Rush PictureGurus, My place of birth is different in my passport than that of my birth certificate. I will have the place of birth changed in my passport. Could you pls tell me how difficult/messy is to have the uscis change the place of birth in my h1b petition based on my new passport. I am currently in my second year h1b. please throw light on any possible complications both serious and trifle. I dont have my h1b visa stamped yet. My GC process is going to start soon.

Nothing is difficult, my friend :), as long as you have an excellent attorney to support you. Most attorneys know how to handle your kind of scenario. Please engage services of a seasoned immigration attorney who will do the needful, by writing to USCIS.

We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.

My interview went fine. I got the H1 stamping done today at hyd counselate. The interview was pretty short. I showed him all the important certificates ( Passport + petition + Hdfc fee slip + DS forms ). Then he asked me the following questions:
Why do I want to go to US?
where I am working?
How long have I been working?
What do I do in my job?
APPROVED!
This is my number -- **********. If u have any question give me a call. This number is valid till april10th... after that I will be in US.

2010 California Gold Rush Picture
The California Gold RushMy friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

� Filed I-140 & I-485 concurrently with a PD of Nov 2007 (Original Labor) - I-140 Approved and I-485 Pending
� Filed I-140 with PD March 2005 (Substitution Labor) - I-140 Approved.
Questions:
1. I would greatly appreciate if you can let me know what are my options and any relative information (Letter formats etc.)
2. Can Info-Pass work instead of writing to USCIS?

Just be candid and talk to your employer. Sometimes they don't even know this as diff ppl in HR handle and interpret cases differently. I would talk to my employer.
my employer has no clue whether it can be done or not. however i posted this same Q to my attorney. i am waiting for the response from him. If anyone else have any inputs, i would appreciate it.

My H1B extension was approved for only 6 months, based on the SOW (Client Contract) end date (rather than the usual 3 year extension).
I would be just about in my maternity leave for the pregnancy during the petition expiry and if my further extension is denied (god forbid), I was told that I would be terminated from my employers' payroll and I have to leave the country or change my status to Student, Visitor etc.
FYI: I'm working for this company since Oct 2005.
Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?

Slightly sooner than expected but the H1B cap was reached today. U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2011. USCIS is notifying the public that yesterday, Jan. 26, 2011, is the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY2011.
The final receipt date is the date on which USCIS determines that it has received enough cap- subject petitions to reach the limit of 65,000. Properly filed cases will be considered received on the date that USCIS physically receives the petition; not the date that the petition was postmarked. USCIS will reject cap-subject petitions for new H-1B specialty occupation workers seeking an employment start date in FY2011 that arrive after Jan. 26, 2011.
USCIS will apply a computer-generated random selection process to all petitions that are subject to the cap and were received on Jan. 26, 2011. USCIS will use this process to select petitions needed to meet the cap. USCIS will reject all remaining cap-subject petitions not randomly selected and will return the accompanying fee.
On Dec. 22, 2010, USCIS had also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the �advanced degree� exemption. USCIS will continue to accept and process petitions that are otherwise exempt from the cap.

Interesting situation. Technically you will be better off on H1 (since you have that approved for 3 years). I would do that if I were you.
Only issue I can think off is, f your husband (Iam assuming primary 485 applicant), would move over to EAD (after Sep-07), would that impact your H1 in any way(I don't think it should).
